PK MARS MEDICAL LTD is the controller of the personal information described in this Privacy Notice unless another service provider explains that it acts as a separate controller for information it collects directly from you.

  1. What personal information we collect

Depending on how you use Driving Health, we may collect:

your name, date of birth, postal address, email address and telephone number;
your driver type and driving licence or medical renewal date;
your employer or company details where you choose to provide them;
your membership plan and membership status;
details of the annual member benefit you choose;
information needed to administer a benefit or reimbursement, such as receipts, invoices or booking evidence;
payment and transaction information;
information you provide when you contact us or submit a website form;
information about dependants where this is required to arrange access to an eligible service;
technical information about use of our website, including information collected through cookies and similar technologies.

We do not ask members to provide medical records, diagnoses or clinical information as part of the standard Driving Health membership application.

If you submit evidence for a member benefit, please do not send medical information that is not necessary for us to process the claim.

  1. How we use your information

We use personal information to:

set up and administer your Driving Health membership;
take and manage membership payments;
provide access to membership benefits and services;
arrange or verify your chosen annual member benefit;
communicate with you about your membership;
send relevant driver medical or licence renewal reminders where this forms part of your membership service;
deal with enquiries, cancellations, complaints and refunds;
prevent fraud and misuse of membership benefits;
maintain business, accounting and tax records;
comply with legal and regulatory obligations;
maintain the security and operation of our website;
send marketing communications where permitted by law.
4. Our lawful bases for using your information

Under UK data protection law, we rely on one or more of the following lawful bases:

Contract – where processing is necessary to enter into or perform your Driving Health membership agreement.

Legal obligation – where we need to process information to comply with a legal, tax, accounting or regulatory requirement.

Legitimate interests – where necessary for the proper operation of our business, including membership administration, fraud prevention, customer service, security and relevant service reminders, provided those interests do not override your rights and interests.

Consent – where we ask for your consent, for example for certain marketing communications or non-essential cookies. You can withdraw consent at any time.

  1. HealthHero services

Some Driving Health membership services are provided by HealthHero.

We may provide HealthHero with the limited personal information required to confirm your eligibility for those services and enable access.

When you use HealthHero services directly, HealthHero collects and processes information needed to provide its services, including health information where appropriate. HealthHero provides its own privacy notice explaining how it handles that information.

Driving Health does not routinely receive your HealthHero clinical consultation notes or medical records simply because you use a HealthHero service.

  1. Payments

Payments are processed using Stripe.

Stripe may collect payment card details, payment information, device information and other information necessary to process payments, prevent fraud and operate its payment services.

PK MARS MEDICAL LTD does not receive or store your full payment card number.

Stripe may act as a processor or controller depending on the activity concerned and provides its own privacy information explaining how it uses personal data.

  1. Other organisations we may share information with

We may share personal information, where necessary, with:

HealthHero and other organisations supplying membership benefits;
Stripe and other payment service providers;
Specsavers or an appointed eyecare benefit provider where required to administer an eligible voucher or benefit;
website hosting, email, form and IT service providers;
professional advisers such as accountants, legal advisers or insurers;
regulators, courts, law enforcement agencies or public authorities where required by law.

We only share information that is reasonably necessary for the relevant purpose.

We do not sell your personal information.

  1. Dependants

Where a Driving Health membership includes access to specified services for eligible dependants, we may need limited information about the dependant to establish eligibility or arrange access.

If you provide personal information about another person, you should ensure that you are authorised to provide it.

HealthHero or another service provider may collect additional information directly from the dependant when they use the service and will provide its own privacy information where applicable.

  1. Driver medical and licence reminders

If you provide us with a licence, medical or renewal date, we may use that information to provide reminders connected with your Driving Health membership.

You can ask us to stop these reminders at any time without cancelling your membership.

  1. Marketing

We may send information about Driving Health products, benefits or services where permitted by law.

Where consent is required, we will ask for it.

You can opt out of marketing at any time by using an unsubscribe link or contacting us.

Opting out of marketing does not prevent us from sending essential communications about your membership, payments or services.

  1. Cookies

Our website uses cookies and similar technologies.

Essential cookies may operate where necessary for the website to function. Non-essential cookies are controlled through our cookie consent system.

You can accept, reject or change your cookie preferences using the cookie controls on the website.

  1. How long we keep your information

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected and to meet legal, accounting and regulatory requirements.

Membership and customer records may be retained after membership ends where necessary to deal with legal claims, complaints, payments or regulatory obligations.

Financial and accounting records are generally retained for at least six years where required for company and tax record-keeping purposes.

Information that is no longer required will be securely deleted or anonymised.

  1. International transfers

Some of our technology and payment service providers may process personal information outside the United Kingdom.

Where personal information is transferred internationally, we will use suppliers that provide an appropriate lawful mechanism for the transfer, such as an applicable UK adequacy arrangement or recognised contractual safeguards.

Individual service providers may give further information about international transfers in their own privacy notices.

We take appropriate technical and organisational measures to protect personal information against unauthorised access, loss, alteration, disclosure or destruction.
